BRS Obtains Dismissal in Jefferson Parish

BRS attorneys Stephen Barry and Katie Stevenson obtained the dismissal of an insurance carrier on a complex insurance coverage issue in Jefferson Parish, Louisiana.  The court granted BRS’s motion for summary judgment on grounds that the vehicle alleged to be involved in the accident was not listed on the insurance carrier's policy and therefore was not a covered auto under the terms of the policy. The plaintiffs attempted to delay the motion for summary judgment action by arguing that additional discovery was necessary to address several issues including whether the driver was operating a temporary substitute vehicle or a non-owned vehicle with the permission of the owner. BRS addressed the plaintiff’s last minute coverage issues, persuaded the court that no additional discovery was necessary and argued that the case was ripe for summary judgment.  Due to the diligent litigation work of BRS attorneys the presiding judge rejected the plaintiff’s arguments and ordered a complete dismissal, with prejudice, of the insurance carrier.
