BRS Secures Significant Appellate Victory Affirming Insurance Coverage Exclusion

New Orleans, LA — August 8, 2025 — BRS is proud to announce that attorneys Stephen Barry and W. Briggs Scott successfully defended a major appellate case resulting in a complete victory for their client. The Louisiana Fourth Circuit Court of Appeal unanimously affirmed the trial court’s summary judgment, confirming that the insurance policy at issue unambiguously excluded coverage for the claims brought against their client.
The case centered on whether a homeowner’s insurance policy provided coverage for injuries arising from the use of a recreational off-road vehicle. Plaintiffs argued that certain policy provisions created a conflict that should be resolved in favor of coverage. Barry and Scott effectively demonstrated that a specific policy endorsement clearly and unambiguously excluded such coverage, and under Louisiana law, the endorsement controlled.
The appellate court agreed, holding that the endorsement’s exclusion applied exactly to the circumstances of the case, leaving no coverage under the policy. The decision not only upholds the trial court’s ruling but also reinforces well-established principles of Louisiana insurance contract interpretation. In particular, the ruling confirms that clear and unambiguous endorsements prevail over general policy language.
