Barry, Rome & Scott successfully resolved a personal injury lawsuit involving an allegedly injured “passenger” whose claim collapsed under a fraud investigation led by BRS attorney Stephen Barry.
The plaintiff asserted they were riding in a vehicle involved in a collision with our insured client. However, early inconsistencies in the account prompted a focused fraud investigation. Through discovery, deposition testimony, and analysis of text messages and other communications, Mr. Barry uncovered evidence showing the plaintiff was never in the vehicle involved in the accident. Instead, the plaintiff arrived in a separate vehicle and only entered the involved car after the collision, later reporting themselves as a passenger.
By exposing these discrepancies and establishing a clear factual record, BRS demonstrated that the fraudulent passenger injury claim lacked credibility and could not be supported by the evidence.
“This case highlights the value of aggressive investigation and rigorous fact development in defending against illegitimate claims,” said Stephen Barry.
Barry, Rome & Scott remains committed to protecting insurers and their insureds by aggressively investigating and challenging questionable or inflated claims.
