St. Landry Parish - Attorneys Curt Rome and Stephen Barry successfully defended a special needs program and its employee against a wrongful death claim brought by the family of a program participant. The death occurred after a program participant choked on a sandwich while eating on a transport van despite instruction not to. A St. Landry Parish jury fully exonerated the van driver and assigned liability to others involved in the care of the participant including the participant himself, his sister, and other programs involved in the participant’s care. Rome and Barry convinced the jury to ignore the plaintiffs’ request for $7.5 million and award a modest award to the family.
